Terms of Service Agreement

1. Definitions

• Account: the registered account you create to use certain features of the Service.
• Profile: the information you submit to present yourself on the Service (e.g., name, bio, photo, location, preferences etc.).
• Recommendations: any rating, review, endorsement, comment, or similar content you submit about a person, business, product, place, or service.
• User Content: all content you submit or make available through the Service, including Profiles and Recommendations.
• Content: the Service and all content made available by us, excluding User Content.

2. Eligibility and Account Registration

You must be at least 16 years old (or the minimum age required in your country) to use the Service. You agree to provide accurate, current, and complete information and to keep your Account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account.

3. Profiles and Recommendations (User Content)

The Service allows users to create Profiles and to post Recommendations. You are solely responsible for your User Content and the consequences of posting it. When you post Recommendations, you agree that they are truthful to the best of your knowledge, reflect your genuine experience or opinion, and are not misleading.

• No fake, fabricated, or impersonated Recommendations.
• No undisclosed incentives: if you received a benefit (e.g., discount, free product/service, payment) in connection with a Recommendation, you must clearly disclose it.
• No harassment, threats, hate, or abusive language.
• No defamatory statements or unlawful allegations about individuals or organisations.
• No sharing of personal data about others without a lawful basis and their permission (e.g., phone numbers, home addresses, private emails).
• No spam, solicitations, or repetitive promotional content.

4. Your Content: Ownership, Licence, and Permissions

You retain any rights you may have in your User Content. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, transferable, and sublicensable licence to host, store, reproduce, modify (for formatting and display), distribute, and publicly display your User Content for the purpose of operating, improving, and promoting the Service. You represent and warrant that you have all rights necessary to grant this licence.

5. Acceptable Use

You agree not to misuse the Service. In particular, you must not (and must not attempt to):

• use the Service for any unlawful purpose;
• post User Content that infringes intellectual property rights or other rights of others;
• reverse engineer, scrape, crawl, or access the Service using automated means except where permitted by law or by our written permission;
• circumvent security or access restrictions;
• interfere with the operation of the Service or other users' enjoyment of it;
• create multiple accounts to evade enforcement actions;
• upload malware or otherwise compromise the security of the Service.

6. Moderation, Reporting, and Removal of Content

We may (but are not obligated to) review, monitor, or remove User Content, and we may suspend or terminate Accounts, at any time and for any reason, including where we believe content or conduct violates these Terms, applicable law, or our community standards. We also offer mechanisms to report content you believe is illegal, infringes rights, or violates these Terms.

To report content, contact us at info@rcmd.me with: (a) the URL or clear description of the content; (b) why you believe it violates these Terms or the law; (c) your name and contact information; and (d) any supporting details (e.g., proof of rights ownership for copyright complaints). We will review reports and may remove or restrict content and/or take action against Accounts.

7. Privacy and Data Protection

We process personal data in accordance with our Privacy Policy. Where applicable, we handle personal data under the UK General Data Protection Regulation and the Data Protection Act 2018. Please do not post personal data about others in Recommendations unless you have permission and a lawful basis to do so.

8. Intellectual Property

The Service and Content (excluding User Content) are owned by us or our licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal or internal business purposes (as applicable).

9. Third-Party Services and Links

The Service may contain links to, or integrations with, third-party websites or services. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and may be governed by their terms.

10. Disclaimers

Recommendations and other User Content reflect the views of the users who post them. We do not endorse, verify, or guarantee User Content. The Service is provided on an "as is" and "as available" basis, and to the maximum extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

11. Limitation of Liability

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law. Subject to that, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any viable claim as proven in the courts of England and Wales will not exceed the greater of (a) £100 and (b) the amounts you paid us (if any) in the 12 months before the event giving rise to the claim.

12. Indemnity

You agree to indemnify and hold us harmless from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your User Content, (b) your use of the Service, or (c) your breach of these Terms.

13. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service (including your Account) at any time if we reasonably believe you have violated these Terms or if we must do so to comply with the law or protect the Service or other users. Sections that by their nature should survive termination will survive (including content licences, disclaimers, limitation of liability, and indemnity).

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by posting an update in the Service or emailing you). Your continued use of the Service after the effective date of the updated Terms constitutes acceptance.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service, except where mandatory consumer protections apply.
